Trademark Search in India
Overview

Trademark Search: Check Before You File

A Trademark Search is done to ensure that any trademark which an applicant wishes to register does not cause a likelihood of confusion with an already applied mark. It's the very first step before filing a trademark application.

We at S.K. & Associates offer a free trademark search service. We have an updated database for ease of the process, and this is a hassle-free online process for you.

Skipping a search is one of the most common reasons applications get objected under Section 11 (similarity with existing marks) or rejected outright. A quick, thorough search today saves you months of objections, hearings, and re-filings tomorrow.

Types of Search

Types of Trademark Search

Three distinct search methods — each catches a different kind of conflict.

Word Search

This type of search allows you to retrieve trademarks that use the same word as that of the query entered. It catches exact word matches in the trademark database.

Vienna Code Search

In some cases, a trademark may contain the same visual elements as that of other companies. It would be difficult to search for such marks. India is a member of the Vienna Convention, so it follows the international classification for the same.

Phonetic Search

The phonetic search interface is used in the case of similar-sounding trademark words. It is a useful type of search as it sometimes provides results having a different spelling but a similar sound.

Classification

Trademark Search Classes: NICE Classification

According to the NICE classification, trademarks are classified into 45 categories — 34 for goods and 11 for services.

Classification of Goods
  • Finished goods: Classified according to their purpose or function. If the function isn't mentioned, users can classify by analogy with comparable finished products (in the alphabetical list).
  • Multi-purpose finished goods: Classified on the basis of any one of their functions. If the function isn't mentioned, by the material or mode of operation.
  • Raw materials: Whether unworked or semi-worked, classified on the basis of the material they consist of.
  • Products made of different materials: Classified on the basis of the material that predominates.
  • Parts of another product: Classified in the same class as that product only when the same type of goods cannot normally be used for another purpose.
Classification of Services
  • The principal basis is according to the branches of activities specified in the headings of the service classes and in their explanatory notes. If not, using other services mentioned in the Alphabetical List.
  • In the case of rental services, the classification is in the same class as the "services provided by means of rented objects."
  • Any service that provides advice, information, or consultation is classified in the same class as the matter of the advice, information, or consultation.

Why class selection matters: Each class represents a unique category of goods and services. Choosing the right class is essential — filing in the wrong class can leave your brand unprotected in the areas that actually matter to your business.

Why It Matters

Why is Trademark Search Necessary?

Trademark search is very advantageous at many steps of your trademark registration process.

Save Time Before Registration

Before registration, conduct a search. This saves time and effort — if there are trademarks similar to yours, you can opt for something novel and won't file a conflicting mark.

Avoid Refusal or Rejection

There is a chance of refusal or rejection of your trademark if it doesn't comply with the Trademark Act, 1999 — particularly Section 11 similarity grounds.

Save Effort After Registration

A search saves time even after registration. If a mark you registered later faces infringement or revocation risk, a search beforehand could have avoided it.

Confirm Brand Distinctiveness

The search tells you whether your brand is different and attractive enough to attract customers — creating a sense of exclusivity for your brand.

Beyond Search

Portfolio Management & Infringement

Trademark Portfolio Management

Portfolio management indicates the management of an application from the beginning to the end. The portfolio includes:

  • Docketing of the filed application
  • Tracking upcoming deadlines
  • Informing clients about the deadlines
  • Coordinating with foreign attorneys regarding applications filed outside India
  • Complete management of application till registration and renewal
Trademark Infringement

In case one uses a registered trademark without authorization of the trademark owner, it is considered trademark infringement — an offence under the Trade Marks Act, 1999.

  • Owner can issue a notice to the infringer to stop using the mark
  • If infringement continues, action to seize violating goods can be initiated
  • Claims for damages can be filed against the infringer
  • Customs enforcement can help intercept counterfeit imports
Pitfalls

Common Mistakes with Trademark Search

Skipping the search entirely: Filing without a search is the most common reason for Section 11 objections. A 10-minute search saves months of objections.
Only doing an exact word match: Searches must include phonetic variations and Vienna-coded visual elements. Exact matches alone miss most conflicts.
Searching only your own class: Even if your class looks clear, similar marks in related classes can trigger objections — especially for well-known brands.
Relying solely on the free tool without expert review: Automated tools return raw data. Expert interpretation of similarity, deceptiveness, and likelihood of confusion is what actually matters.
Not updating the search before refiling: New applications are filed every day. A search done months ago may be stale — always re-search before final filing.
Ignoring phonetic similarity across languages: Marks that sound similar in Hindi, English, or regional languages can conflict even if spelled differently.

FAQ

Frequently Asked Questions

A Trademark search is done to ensure that any trademark which an applicant wishes to register does not cause a likelihood of confusion with an already applied mark. We at LegalRaasta offer a free service of trademark search — with an updated database and a hassle-free online process.

You can use our Trademark Search service by simply visiting our website. There are 2 steps: first, visit the trademark search page, then fill in the required details along with your query for our experts.

There are three types: Word Search (retrieves trademarks using the same word as your query), Vienna Code Search (catches similar visual elements based on the Vienna Convention classification India follows), and Phonetic Search (finds similar-sounding marks with different spellings).

A trademark, also known as a brand name, could be a word, signature, label, name, device, numerals, or combination of colours used by a company on goods or services. It is used to distinguish one company's product or service from another.

The trademark should be capable of being represented graphically, and it should be capable of distinguishing your goods and services from others.

A trademark can be cancelled if the mark is descriptive, not distinctive, misleading or disparaging, functional, generic, consists of a geographical indication, is against public policy or morality, is used misleadingly, is prohibited in the jurisdiction, was applied for in bad faith, or contains protected armorial bearings, flags, or State emblems.

The opposition period starts on the date the Trade Marks Journal is made available to the public and ends after 4 months (120 days). There is no extension to this date, and anyone can oppose your trademark application.

Types include: any name (or surname) not unusual as a trademark, letters/numerals or combinations, devices (symbols), monograms, colour combinations, shape of goods or packaging, 3-D marks, sound marks, invented words, and arbitrary dictionary words not directly descriptive.

The Trade Marks Act, 1999; national bilateral treaties; regional treaties; court decisions; international multilateral conventions; office practice in Manuals and guidelines; IPAB decisions (now High Courts); and textbooks by academicians and professional experts.

Every registered trademark with the Trademarks Registry is valid for a specific period of 10 years. Afterward, it has to be renewed with a fee.

The process is comprehensive and involves proceedings, hearings, and objections. It can take anywhere from 20-24 months. However, a trademark application number is issued within 7 working days of filing the application.

IP India Public search refers to the method of looking for trademarks that have already been registered by the Registrar of Trademarks. It helps brands avoid trademark infringements and their legal ramifications.
