Patent Registration in India: Complete Guide (2026)

After the procedure of patent registration, one gets the property right to an invention administered by an individual or a firm. If your invention is unique, the government will grant you the full right for your product.

A patent grants you the full right of making, using, selling, or importing the product or process — and prohibits others from doing so. In India, patents are governed by the Patent Act, 1970 and the Patent Rules, 1972.

The lifetime of a patent is 20 years. This period is fixed in most cases and cannot be extended by the act of parliament — except in rare instances where it could be extended by a couple of years. A patent can cover a process, art, method of manufacture, particular apparatus, machine, computer software, chemical, drug, or technical application.

Definition

What is Patent Registration?

Patent Registration is the legal process by which an inventor obtains an intellectual property right to their invention — granted by the government in exchange for full disclosure of the invention to the public.

Once granted, a patent awards you the full right of making, utilizing, selling, or bringing in the item or process and denies others from doing so. It becomes an intangible asset that can be licensed, sold, or used to raise capital.

The patent could be for a process, art, method of manufacture, particular apparatus, machine, computer software, chemicals, drugs, or technical application. We at S.K. & Associates act as a patent specialist and assist organisations with registering in Delhi NCR, Mumbai, Bengaluru, Chennai, and all other Indian cities.

Detailed Process

The Full Patent Registration Journey

01
Patentability / Novelty Search

This is a required step, in case you haven't done so. Before getting on the way to completing the patent registration process, you should know whether a patent is going to be available for it or not. For this, you need to run a patent search first.

02
Drafting of Patent Application

After the patentability search, the innovator ought to prepare an application in Form 1. Then attach patent details with every application in Form 2, where the complete or provisional specification is referenced depending on the state of development. If it is provisional, a time period of 12 months is given to finish the invention and file the complete application.

03
Filing the Patent Application

Step 1: For an application for grant of patent, use Form 1. Step 2: For provisional/complete specification, use Form 2. Step 3: For statement and undertaking under Section 8 (used when a patent application is already filed in a country other than India), use Form 3. Step 4: For declaration as to inventorship, use Form 5. Step 5: For start-ups and small entities, use Form 28.

04
Patent Filing — Ideation & Visualization

Ideation: At this stage, the designer is required to pen down the thought or idea and note the key insights regarding the creation that should be protected. Visualization: Create a visual description of your idea in the form of diagrams that clarify the innovation progressively.

05
Publication of Patent Application

The application filed with the patent office will be distributed in the official patent diary — done within 18 months of filing. The inventor can use Form 9 for early publication. If there is some limitation set by the Indian Patent Act concerning publishing, it will not be published in the journal.

06
Examination

The examination process is done before the patent is allowed, and the application for examination must be made in Form 18. This procedure should not be deferred, as it works on a first-come-first-serve basis. After this application is filed, it is given to the patent officer who verifies every condition per the patent rules.

07
Issuance of Examination Report

After a comprehensive search is conducted, the First Examination Report (FER) is filed in this case, listing objections or clarifications required.

08
Grant of Patent

After the Patent Officer recognises the fulfilment of complaints raised, the patent is granted. The invention is then legally protected for 20 years.

According to the Patents Act, Sections 3 and 4 carry the list of non-patentable topics. Your invention must not fall under this list.

Inventive Step / Non-Obviousness

The subject you wish to patent should not be obvious to specialists in the field. It should be technologically advanced or economically gainful to be patented.

Novelty

The invention should be new and creative. It should not have been used in the public domain anywhere in the world.

Industrial Applicability

The invention should be handy and usable in industries or the public domain — not just a theoretical idea.

Which one for your app? If it's the technical idea you seek protection for, then getting it patented is a good option — provided it meets the patentability criteria. If you wish to protect just the logo and designs used, a trademark would be more feasible. Literary and artistic works within your app can be protected by copyright.

After the expiration of the patent, the patentee is supposed to disclose the invention in the patent document for anyone to practice — the invention then enters the public domain.

Yes, conducting a patent search first is highly advised. Every year, many new inventions are patented, and even more are rejected due to copied reasons. A prior patent search saves time, effort, and government fees.

It is advised that you first complete the process of patent registration and only then disclose the information to potential investors. In case it is unavoidable, we recommend a Non-Disclosure Agreement (NDA) with your potential investor.
