Understanding

Understanding Income Tax Returns in India

We have two types of taxes in India — Direct Tax and Indirect Tax.

Direct Tax is a tax calculated directly on your income, e.g. tax on salary. Income tax is a Direct Tax. Indirect Tax is a tax indirectly charged and put on goods or services — for example, when you purchase a mobile phone or a new suit. Most indirect taxes have now come under Goods and Services Tax (GST).

Income Tax (Direct Tax): Anyone earning an income above a certain amount is subject to income tax. The income could be from salary, rent, interest from savings, income from mutual funds, sale of property, or business or professional income. Income tax rates are decided at the start of the financial year in the Union Budget. The tax paid on these incomes is called income tax.

Income Tax Return: It is simply a form to be filed with the Income Tax Department — a statement of income earned. It is arranged so that calculating tax liability, scheduling tax payments, or requesting refunds for overpayment of taxes is convenient for the taxpayer. The type of ITR form you need depends on the income you earn. Its purpose is to report your income and taxes paid thereon to the government.

Benefits

Benefits of Filing Income Tax Returns

Many investors have very low or zero tax liability, but filing still matters — here's why.

Processing of Loans & Visa

If you apply for a home loan, car loan, etc., your eligibility and quantum depend on your income — established through filed ITRs. Overseas travel also requires proof of earning; for self-employed individuals, ITR is that proof.

Claiming Refund

If TDS was cut on some investment, or you paid excess tax, you must file ITR to claim a refund. Many salaried individuals don't file ITR thinking TDS covers them — but your employer may have paid more tax than needed without considering HRA, school fees, or tax-saving investments.

Carry-Forward Losses

Under Income Tax rules, losses can be carried forward and set off against capital gains — but only if you file ITR in the relevant assessment year. Capital losses can be carried forward for 8 consecutive years.

Establishing Income in Compensation Cases

Though the Motor Vehicles Act doesn't make ITR compulsory for compensation, Delhi High Court procedures require ITR for self-employed persons to establish income and arrive at appropriate compensation.

Self-Employed Filing for Tenders

Businessmen, consultants, and partners don't get Form 16. For them, ITR receipts are the only proof of income and tax payment — often required for contracts or tenders covering 3 to 5 years.

Being a Responsible Citizen

Staying on the right side of law matters. Filing returns — even voluntarily if you earn below the slab — signals that you're a responsible taxpayer.

Important

Penalties Under the Income Tax Act

Different penalties apply to different defaults — some mandatory, some at the discretion of tax authorities.

Incorrect Form

If an incorrect form is used, the return is treated as "defective". You get 15 days from intimation (Section 139(9)) to file a revised ITR using the correct form. If not corrected in time, it's treated as an invalid return — same as not filing at all.

Under-Reporting

If actual income exceeds declared income, or no return was filed despite income exceeding the exemption limit — penalty of 50% of tax payable on under-reported income. If under-reporting results from misreporting, penalty rises to 200%.

Late Filing

As per Section 234F, filing after 31st July but before December attracts ₹5,000 penalty. Filing after December attracts ₹10,000. For small taxpayers with income under ₹5 lakh, the penalty is capped at ₹1,000.

Penalty for Default

If a demand notice u/s 156 is issued, payment must be made within 30 days per Section 220(1). Failing this, the taxpayer is treated as an assessee in default, with penalty decided by the AO — capped at the arrears amount.

Delay in TDS/TCS Statement

Failing to file TDS/TCS returns on time attracts ₹200 per day of delay under Section 234E — capped at the TDS/TCS amount. A late TDS/TCS return cannot be filed without paying this fee.

Undisclosed Income

If the AO adds income under Sections 68, 69, 69A, 69B, 69C, or 69D without satisfactory explanation, penalty of 10% of tax payable is levied — unless income was disclosed in ITR and tax paid u/s 115BBE.

Pitfalls

Common Mistakes While Filing ITR

Selecting an incorrect form: Choosing the wrong ITR form can result in your return not getting processed. All incomes must be reported using the correct ITR form applicable.
Not reporting all sources of income: Whether taxable or exempt, all income must be disclosed. Savings interest, FD interest, rental income, short-term capital gains — nothing should be left out. Not reporting can attract a notice.
Providing incorrect personal information: PAN, name, address, email, phone, DOB, bank account and IFSC must be accurate. A minor mistake can mean missing your refund or notifications.
Failing to reconcile TDS with Form 26AS: Always compare ITR with Form 26AS. If TDS isn't reflected, your refund credit is lost, and mismatches lead to more tax being paid.
Not including exempt income: Income tax laws require all income to be reported, exempt or not. Long-term gains, dividends, etc. must be disclosed even if no tax is payable.
Entering details manually without professional help: The returns follow a set format — errors in formatting lead to rejected returns. Professional assistance avoids this entirely.
Assuming TDS means no ITR needed: When annual income exceeds ₹2.5 lakh, you're obligated to file ITR and report interest income — claiming credit for TDS already paid.
Missing claimable deductions: Deductions up to ₹1.5 lakh under Section 80C, plus others, are frequently unclaimed. Most taxpayers aren't aware of eligible expenses.

Form 16

What is Form 16?

Form 16 can be termed as a Salary TDS (Tax Deducted at Source) Certificate that an employer issues to you for the TDS deducted. It's an Income Tax form used by companies to provide their salaried employees' information on the tax deducted.

As soon as the income from your salary for the financial year exceeds the basic exemption limit, the employer is required to deduct TDS and deposit it with the Government. After deducting TDS, the employer must give a certificate to the employee — this is Form 16.

It consists of two parts:

  • Part A — details about the employer & employee, name and address, PAN and TAN details, TDS deducted & deposited
  • Part B — details related to other income, deductions allowed, etc.
Key Points About Form 16
  • If no TDS has been deducted, you may not be issued Form-16
  • Employees need this at the time of filing tax returns
  • You can quickly file ITR online by directly uploading your Form 16
  • Form 16 is annually issued by the employer by June 15th

FAQ

Frequently Asked Questions

Every person or entity is liable to pay tax in India if their total income is more than the income notified by the government in the slab rates. This includes Individuals (salaried, self-employed or professional), Hindu Undivided Family (HUF), Company, Firm, Association of Persons (AOP), Local Authority, Artificial Juridical Person, Body of Individuals (BOI), Political Party, Educational or medical institution, and Trade Union.

Taxable income is calculated as per the provisions and rules of the Income Tax Act, 1961. Slab rates are applied to the taxable income earned during the previous year, notified in the budget at the end of each financial year. Income is calculated under various heads and added; then deductions and exemptions under Chapter VI-A are applied to get the Net Income Chargeable to Tax.

Returns can be filed both physically and electronically. For e-filing, you can either download the government utility from the Income Tax portal, complete the fields, pay taxes due, generate XML, and upload it — or use our platform which simplifies the entire process with auto-checks and expert review.

ITR-1 has 4 parts. Part A has Personal Details, Part B is about Gross Total Income, Part C has Deductions and Taxable Total Income, Part D has Tax Computation and Tax Status. Schedule IT contains details of Advance Tax and Self-Assessment Tax Payments, and Schedule TDS gives details of Tax Deducted at Source. ITR-1 cannot be used if you are claiming double taxation relief under Section 90/90A/91.

Yes, return filing is compulsory if your taxable income is above the slab, whether taxes have been paid or not. You can claim the benefit of tax credit or get a refund only if your return is filed.

Yes, if any error is discovered after filing, it can be revised under Section 139(5). A Revised Return of Income Tax can be filed any time before the end of the relevant assessment year or before the completion of the assessment, whichever is earlier.

It is mandatory to file income tax returns if: (a) your gross annual income exceeds ₹2.5 Lakhs (below 60 years), ₹3 Lakhs (60–80 years), or ₹5 Lakhs (above 80 years); (b) you earn income other than salary like house property; (c) you want to claim a refund of TDS or advance tax; (d) you earn from or have invested in foreign assets; (e) you are applying for visa or loan; (f) you are a company or firm, irrespective of profit or loss; (g) you have bank deposits over ₹1 crore; (h) you bought foreign exchange over ₹2 lakh; or (i) you paid an electricity bill over ₹1 lakh.

If you are a salaried individual, you just need Form 16. No other document needs to accompany your ITR, though you should keep TDS certificates and proof of investments handy in case authorities ask. If you don't get Form-16, you may need: previous year's tax return, bank statements, TDS certificates, savings certificates, donation receipts, disability certificates, interest statements, and (for business income) balance sheets and P&L statements.

The Previous Year is the same as the Financial Year in which income is earned. Tax is payable on income earned during this Previous Year, and that tax is payable in the Assessment Year, which is the year next to the Financial or Previous Year. For example, for income earned in FY April 1, 2019 to March 31, 2020, the liability to pay tax falls in 2020-2021, known as the Assessment Year.

The due date for filing all ITRs is 31st July for Individuals and 30th September for Businesses. After this deadline, tax returns are treated as a "Belated Return" and can be filed any time before 31st March of the following year — with penalty.

You can pay by either cash/cheque at any designated bank branch, or online on the NSDL website. Payment is made via Challan-280 in both cases. The Challan must be filled accurately for further processing.
